This Privacy Policy describes how SkipFees ("we," "us," or "our") collects, uses, stores, and discloses personal information when you use the SkipFees.ca website, platform, services, and related applications (collectively, the "Services"). This Policy applies to restaurant clients ("Clients"), their customers who place orders through Client websites and applications powered by SkipFees ("End Customers"), and visitors to our website ("Visitors").
By using our Services, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with this Policy, you must not use the Services.
1. Information We Collect
1.1 Information from Clients
When you register for a SkipFees account, we collect business name and legal entity name, contact information (name, email address, phone number, mailing address), business address and operating locations, menu content including item names, descriptions, prices, images, and modifiers, payment and banking information for billing purposes, tax identification numbers where required, and any other information you voluntarily provide during onboarding or through the Platform.
1.2 Information from End Customers
When End Customers place orders through a Client's SkipFees-powered website, mobile app, or other ordering channel, we may collect the End Customer's name, email address, phone number, delivery address, order details and history, payment information (processed through secure third-party payment processors), communication preferences, and loyalty program participation data.
1.3 Information Collected Automatically
When you interact with the Services, we automatically collect certain technical information, including IP address, browser type and version, device type and operating system, pages viewed and features used, date and time of access, referring URL, and cookies and similar tracking technologies.
1.4 Information from Third Parties
We may receive information about you from third-party service providers we work with, including payment processors, delivery partners, analytics providers, and marketing platforms.
2. How We Use Your Information
We use the information we collect for the following purposes: to provide, maintain, and improve the Services; to process orders, payments, and transactions; to set up and manage Client accounts, websites, and mobile applications; to facilitate delivery through third-party delivery integrations; to operate loyalty programs, CRM tools, and marketing campaigns on behalf of Clients; to send transactional communications such as order confirmations, receipts, and delivery updates; to provide customer support and respond to inquiries; to analyze usage patterns and improve the Platform's performance, features, and user experience; to detect, prevent, and address fraud, security issues, and technical problems; to comply with legal obligations and enforce our Terms of Use; and to send administrative communications regarding your account, billing, and changes to our policies.
3. How We Share Your Information
3.1 With Clients
End Customer information, including names, contact details, order history, and preferences, is shared with the applicable Client for the purpose of fulfilling orders and managing the customer relationship. Clients are the data controllers of their End Customer data.
3.2 With Third-Party Service Providers
We share information with trusted third-party service providers who assist us in operating the Platform, including payment processors to facilitate secure transactions, delivery providers (such as Uber Direct) to coordinate order delivery, communication platforms to send order notifications, receipts, and marketing messages, analytics providers to help us understand usage and improve our Services, and hosting and infrastructure providers to maintain and secure the Platform. These service providers are contractually obligated to use your information only for the purposes of providing services to SkipFees and are required to maintain appropriate security measures.
3.3 With Payment Facilitators
If a Client's Subscription Plan includes payment facilitation services such as Klarna, End Customer payment information may be shared with the applicable payment facilitator in accordance with their own privacy policy and terms of service.
3.4 Legal and Compliance Disclosures
We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of SkipFees, our Clients, End Customers, or the public, to enforce our Terms of Use, or to detect, prevent, or address fraud, security, or technical issues.
3.5 Business Transfers
In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred to the acquiring entity. We will provide notice of any such transfer and any changes to the applicable privacy practices.
3.6 No Sale of Personal Information
SkipFees does not sell, rent, or lease personal information to third parties for their independent marketing purposes.
4. Data Ownership
Client data, including End Customer data collected through the Client's use of the Platform, is owned by the Client. SkipFees acts as a data processor on behalf of the Client with respect to End Customer data. SkipFees may use aggregated, anonymized data that cannot reasonably be used to identify any individual for the purposes of improving the Platform, generating analytics and industry benchmarks, and developing new features and services.
5. Data Security
We implement commercially reasonable administrative, technical, and physical security measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit using SSL/TLS protocols, secure storage of payment information through PCI-compliant third-party processors, access controls and authentication measures, regular security assessments, and employee training on data handling and privacy practices. However, no method of transmission over the internet or electronic storage is completely secure. While we strive to use commercially reasonable means to protect your information, we cannot guarantee absolute security.
6. Data Retention
We retain your information for as long as your account is active or as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Upon termination of a Client account, SkipFees will retain Client and End Customer data for a period of 30 days, during which the Client may request a copy of their data. After this period, data may be permanently deleted from our active systems, though it may persist in backup systems for a limited time before being purged.
7. Cookies and Tracking Technologies
We use cookies and similar tracking technologies to collect and store information about your interactions with the Services. Cookies are used for essential operations to enable the proper functioning of the Platform, including session management and authentication; for analytics purposes to understand how users interact with the Services so we can improve performance and usability; and for preferences to remember your settings and customize your experience.
You may manage your cookie preferences through your browser settings. Please note that disabling certain cookies may affect the functionality of the Services.
8. Your Rights
Depending on your jurisdiction, you may have the following rights regarding your personal information: the right to access the personal information we hold about you, the right to request correction of inaccurate or incomplete personal information, the right to request deletion of your personal information subject to certain legal exceptions, the right to object to or restrict certain processing of your personal information, the right to data portability, and the right to withdraw consent where processing is based on consent.

9. Children's Privacy
The Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information promptly. 10. International Data Transfers
Your information may be transferred to, stored in, and processed in jurisdictions outside of Canada, including jurisdictions that may not provide the same level of data protection as Canadian law. The Services may contain links to third-party websites or services that are not operated or controlled by SkipFees. This Privacy Policy does not apply to such third-party services. We encourage you to review the privacy policies of any third-party services you access through the Platform.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will post the updated Privacy Policy on our website with a revised effective date. Where changes are material, we will provide notice through the Platform or via email. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Privacy Policy.

SkipFees is committed to complying with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. In accordance with PIPEDA, we collect personal information only for purposes that a reasonable person would consider appropriate in the circumstances, we obtain consent for the collection, use, and disclosure of personal information except where permitted or required by law, we limit collection to information that is necessary for the identified purposes, we use and disclose personal information only for the purposes for which it was collected unless we obtain further consent or as required by law, and we maintain accurate and up-to-date personal information where necessary for the purposes for which it is used.
